Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the CityMove mobile application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. CityMove is operated by Zdravstveni dom Ljubljana (“we”, “us”, “our”).

2. Eligibility

You must be at least 16 years of age to use CityMove, in accordance with Slovenian data protection law (ZVOP-2, implementing Article 8 of the GDPR). By creating an account, you confirm that you are 16 years of age or older.

3. Account & Registration

• To use the App, you must create an account by choosing a nickname and password. No real name, email address, or phone number is required.
• Upon registration, you will receive a recovery code. This is the only way to recover your account if you forget your password. Keep it safe — we cannot retrieve it for you.
• You are responsible for maintaining the security of your account credentials.
• Each person may only create and use one account. Creating multiple accounts to gain an unfair advantage is prohibited.

4. App Usage Rules

CityMove is designed to encourage walking and exploration in the real world. By using the App, you agree to:

• Use the App honestly and in good faith
• Be aware of your surroundings and follow local traffic and safety rules when walking
• Only scan QR codes at locations you have physically visited
• Not use the App in any way that could harm yourself or others (e.g. while driving or cycling)

5. Virtual Currency & Cosmetics

• The App features virtual currencies: coins and experience points (XP). These are earned through in-app activities (visiting locations, completing challenges, answering quizzes, meeting step goals).
• Coins can be spent on cosmetic avatar items (hats, hair, tops, shoes, accessories) in the in-app shop.
• Virtual currencies and cosmetic items have no real-world monetary value.
• Virtual currencies and items are non-transferable between accounts and non-refundable.
• We reserve the right to modify the virtual economy (prices, rewards, availability of items) at any time.

6. Intellectual Property

All content in the App — including but not limited to the software, design, graphics, avatar assets, maps interface, text, and game mechanics — is the property of Zdravstveni dom Ljubljana and the CityMove project, or is used under licence. You may not copy, modify, distribute, sell, or create derivative works from any part of the App without prior written permission.

7. User Content

User-generated content in CityMove is limited to your chosen nickname, avatar configuration, quiz answers, and questionnaire responses. You agree not to use offensive, discriminatory, or inappropriate nicknames. We reserve the right to change or reset nicknames that violate this rule.

8. Research Questionnaires

CityMove includes standardised research questionnaires as part of the EU-funded CityMove project:

• IPAQ-SF (International Physical Activity Questionnaire) — presented once after account creation. Completion is optional. This questionnaire collects self-reported physical activity data for research purposes.
• uMARS (user Mobile Application Rating Scale) — presented periodically after events. Completion is voluntary and can be skipped.
• Your questionnaire responses are used for scientific research and app improvement only. Responses are pseudonymous and linked to your player ID, not your real identity. See our Privacy Policy for full details.
• Research questionnaires are available after explicit in-app consent. Consent choice, timestamp, and consent version are recorded. You may withdraw consent at any time by contacting us, though previously collected data may be retained in anonymised form.

9. Prohibited Conduct

You agree not to:

• Spoof GPS or location data — using mock locations, VPNs, or any tools to falsify your physical position
• Share your account — allowing others to use your account or using someone else's
• Exploit bugs or vulnerabilities — intentionally abusing software defects for unfair advantage. If you discover a bug, please report it to citymove.eu@proton.me
• Use automated tools — bots, scripts, or other automated methods to interact with the App
• Reverse-engineer the App — decompile, disassemble, or attempt to extract the source code
• Interfere with the service — attempt to disrupt, overload, or compromise our servers or infrastructure

10. Termination

• You may stop using the App at any time. To request deletion of your account and data, contact us at citymove.eu@proton.me.
• We reserve the right to suspend or terminate your account at any time if you violate these Terms, with or without prior notice.
• Upon termination, your access to the App and any accumulated virtual currency, items, or progress may be permanently lost.

11. Disclaimers & Limitation of Liability

• The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied.
• CityMove is not a medical or fitness device. Step counts, distances, and other fitness data are approximate and should not be relied upon for health decisions.
• We are not responsible for any physical injuries, accidents, or damages arising from your use of the App, including while walking to locations.
• We do not guarantee uninterrupted or error-free operation of the App. The service may be temporarily unavailable for maintenance or due to circumstances beyond our control.
• To the maximum extent permitted by applicable law, our total liability for any claims relating to the App shall not exceed the amount you paid for the App (which is zero, as the App is free).

12. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Slovenia. Any disputes arising from or relating to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts in Ljubljana, Slovenia.

13. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via an in-app notification. Continued use of the App after changes constitutes acceptance of the updated Terms. The “last updated” date at the top reflects the latest revision.
